AGB’s
Preamble
These General Terms and Conditions (hereinafter referred to as “GTC”) govern the business relationship between Fabienne In-Albon Milestones GmbH (hereinafter referred to as “FIA Milestones”) and the customers of the website www.fabienneinalbon.ch (hereinafter referred to as “Customers”).
§ 1 Subject Matter of the Contract
FIA Milestones offers various services related to personal and team development on their website. These services may include coaching, workshops, seminars, keynote speeches, and guided activities (hereinafter referred to as “Services”).
§ 2 Conclusion of the Contract
The contract between FIA Milestones and the customers is concluded through the customers’ registration for a service offered by FIA Milestones. Registration can only be done online via the FIA Milestones website. Registrations are confirmed via email, and the invoice is sent by email.
§ 3 Prices and Payment Terms
The prices for the services offered by FIA Milestones are indicated on the Milestones website or in the respective offers. All prices are in Swiss Francs (CHF) and exclude statutory value-added tax.
Payment of the prices is made by bank transfer and is due within 30 days from the invoice date. Installment payments are not possible. If different payment terms are stated on the invoice, the terms stated there apply.
§ 4 Service Provision
FIA Milestones commits to providing the agreed services diligently and conscientiously. FIA Milestones is entitled to engage other persons to provide the services or to involve them in the provision.
FIA Milestones assumes no responsibility for the result of the services or that the services achieve a specific result.
Price and program changes are at the discretion of FIA Milestones. Customers will be informed in a timely manner. FIA Milestones has the right to interrupt service provision at any time if, in their sole assessment, continuing the service could increase risks, especially to the life and health or property of the customers or the coaches involved in the service provision. In this case, customers are not entitled to repeat the service, receive the remaining service, get a refund, or any other compensation.
§ 5 Rebooking, Cancellation, and Withdrawal
Rebooking is not possible. However, customers can cancel their registration for a service up to 4 weeks before the service begins at no cost. In case of a later cancellation, FIA Milestones is entitled to charge a cancellation fee as follows:
- Less than 4 weeks and up to 2 weeks before the service begins: 50% of the invoiced price
- Less than 2 weeks before the service begins: 100% of the invoiced price.
FIA Milestones can cancel the service without further justification before it begins and without replacement, informing customers in a timely manner. In this case, the paid price will be refunded to the customers. Further compensation cannot be claimed.
§ 6 Liability
FIA Milestones is liable for intent and gross negligence. Liability for slight negligence is excluded.
FIA Milestones is not liable for damages caused by customers themselves, other customers, third parties, or force majeure.
§ 7 Cooperation of the Participants
Customers should support FIA Milestones in providing the service to the best of their ability. This includes, in particular, timely provision of all necessary information, documents, and equipment needed by the customers for the service.
Customers are obliged to inform FIA Milestones about their health condition before the service begins. FIA Milestones can refuse participation in a service if they believe that the customer’s health condition poses a safety risk.
Customers are required to comply with applicable laws, regulations, and rules set for such activities during the services. Additionally, customers must behave respectfully towards FIA Milestones and other participants. FIA Milestones can exclude customers from participation in a service without compensation if they do not adhere to the behavioral rules.
§ 8 Data Protection
By participating, customers agree that photos and/or videos of them may be taken during the service provision and used by FIA Milestones for any morally acceptable purposes, unlimited in time and geography. This includes use for advertising (including social media), promotion, and marketing.
Otherwise, FIA Milestones commits to treating customers’ personal data confidentially and only collecting, using, and sharing it within the scope of the consent given by the customers. Customers can withdraw their consent at any time, including during the service provision.
§ 9 Copyright and Confidentiality
The copyright to all photos and video recordings (even if they depict customers) and all materials used in the service provision belongs to FIA Milestones. Any use beyond the service and personal use by the customers requires prior written permission from FIA Milestones. Such use includes, in particular, sharing with third parties and making copies.
Customers commit to treating all personal information about themselves or other customers received from FIA Milestones in connection with the service provision confidentially.
§ 10 Insurance
FIA Milestones assumes no liability for accidents or theft of customers’ belongings. Customers are responsible for arranging appropriate insurance.
FIA Milestones has adequate liability insurance.
§ 11 Final Provisions
These GTC and the contracts concluded with customers are governed by Swiss law.
The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC and the contracts concluded with customers is the District Court of Schwyz.
Should individual provisions of these GTC be invalid or become invalid, the remaining provisions of these GTC remain effective. The invalid provision shall be replaced by a provision that comes as close as possible to the meaning and purpose of the invalid provision.
