Präambel
These General Terms and Conditions (hereinafter referred to as “GTC”) govern the business relationship between Fabienne In-Albon Milestones GmbH (hereinafter referred to as “FIA Milestones”) and the customers of the website www.fabienneinalbon.ch (hereinafter referred to as “Customers”).
§ 1 Subject of the contract
FIA Milestones offers various services related to personality and team development on its website. These services may include coaching, workshops, seminars, keynote speeches and presentations, as well as guided activities (hereinafter referred to as “Services”).
§ 2 Conclusion of contract
The contract between FIA Milestones and the Customers is concluded when the Customers register for a service offered by FIA Milestones. Registration can only be done online via the FIA Milestones website. Registrations are confirmed by e-mail and the invoice is sent by e-mail.
§ 3 Prices and terms of payment
The prices for the services offered by FIA Milestones are stated on the Milestones website or in the respective offers. All prices are in Swiss Francs (CHF) and are exclusive of statutory VAT.
Payment of the prices is made by bank transfer and must be made within 30 days of the invoice date. Payment in instalments is not possible. If other terms of payment are stated on the invoice, the terms stated there shall apply.
§ 4 Service provision
FIA Milestones undertakes to provide the contractually agreed services carefully and conscientiously. FIA Milestones is entitled to commission other persons to provide the services or to involve them in the provision of the services.
FIA Milestones accepts no responsibility for the result of the services or that the services will achieve a specific result.
FIA Milestones has the discretion to make price and program changes. Customers will be informed of this in good time. In particular, FIA Milestones has the right to interrupt the provision of services at any time if, in the sole opinion of FIA Milestones, the continued provision could lead to an increase in risks, especially to the life, limb or property of the Customers or the coaches entrusted with the implementation. In this case, the Customers are not entitled to a repetition of the service, provision of the remaining service, reimbursement of the price or other compensation.
§ 5 Rebooking, cancellation and withdrawal
Rebooking is not possible. However, the Customers can cancel their registration for a service free of charge up to 4 weeks before the start of the service. In the event of a later cancellation, FIA Milestones is entitled to charge a cancellation fee, which is calculated as follows:
- Less than 4 weeks and up to 2 weeks before the start of the service: 50% of the invoiced price
- Less than 2 weeks before the start of the service: 100% of the invoiced price.
FIA Milestones can cancel the service before it begins without further justification and without substitution, and the Customers will be informed of this in good time. In this case, the Customers will be reimbursed the price paid. Further compensation cannot be claimed.
§ 6 Liability
FIA Milestones is liable for intent and gross negligence. Liability for slight negligence is excluded.
FIA Milestones is not liable for damages caused by the Customers themselves, by other customers, by third parties or by force majeure.
§ 7 Participation of the participants
Customers should support FIA Milestones in the provision of the service to the best of their ability. This includes in particular the timely provision of all necessary information, documents and equipment required by the Customers for the provision.
The Customers are obliged to inform FIA Milestones about their state of health before the start of the service. FIA Milestones can refuse participation in a service if it is of the opinion that the state of health of the Customers poses a safety risk.
Customers are obliged to comply with the applicable laws, regulations and rules established for such activities during the services. The Customers are also obliged to behave respectfully towards FIA Milestones and other participants. FIA Milestones can exclude Customers from participating in a service without any claim for compensation if they do not comply with the rules of conduct.
§ 8 Data protection
By participating, the Customers agree that photos and/or videos of them may be taken during the provision of the service and may be used by FIA Milestones for any purposes corresponding to good morals without any restriction in terms of time or geography. This includes use for advertising (including social media), sales promotion and marketing.
Otherwise, FIA Milestones undertakes to treat the personal data of the Customers confidentially and only to collect, use and pass it on within the scope of the consent given by the Customers.
Customers can revoke their consent at any time, even during the provision of the service.
§ 9 Copyrights and confidentiality
The copyright to all photo and video recordings (even if they depict Customers) as well as to all documents and materials used for the provision of services lies with FIA Milestones. Use by the Customers that goes beyond the service and personal use requires the prior written consent of FIA Milestones. Such use requiring approval includes in particular the transfer to third parties and the creation of copies.
Customers undertake to treat all personal information about themselves or other Customers that they receive from FIA Milestones in connection with the provision of services as confidential.
§ 10 Insurance
FIA Milestones accepts no liability for accidents of the Customers or theft of items belonging to the Customers. The Customers are responsible for taking out appropriate insurance.
FIA Milestones has adequate liability insurance.
§ 11 Final provisions
These GTC and the contracts concluded with Customers are subject to Swiss law.
The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC and the contracts concluded with Customers is the District Court of Schwyz.
Should individual provisions of these GTC be or become invalid, the remaining provisions of these GTC shall remain valid. The invalid provision shall be replaced by a provision that comes as close as possible to the meaning and purpose of the invalid provision.
